The ninth circuit court has maintained a ban on sending national guard in the Oregon city, after a recent legal decision.

Judicial Panel Concurs to Reconsider Case

The federal appeals court ruled on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of eleven justices. The judicial body also vacated a previous ruling from a smaller judicial group that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the latest development in a long-running legal battle over whether the administration has the authority and justification to deploy state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was started in response to months of protests.

Conflicting Arguments

The administration has argued that government employees at the immigration center in south Portland were facing threats, while local authorities maintain that local officers have command of the situation.

Contrary to descriptions of Portland as “war ravaged”, locals have been posting videos of scenic paths and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a US district judge in the city issued two temporary restraining orders this period – one blocking the federal control of the state troops, and another stopping the use of any military personnel in the state, after attempts to circumvent the initial injunction by mobilizing out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – allowing command of 200 Oregon national guard – but the second ruling stayed effective, blocking the physical sending of the troops.

Full Panel Consideration

The latest ruling means the matter will be heard “en banc” – with both rulings under consideration simultaneously – by a group of 11 judges.

“This decision demonstrates that the truth matters and that the judicial system are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The judicial body is sending a clear message: the executive leader cannot send the armed forces into American urban areas without cause. We will continue protecting Oregon’s laws, principles, and autonomy as this case moves forward and our fight continues in the judicial system.”
